Terms of Use

Please read before using SCRATCHmail

Effective date: September 18, 2026

These Terms of Use (“Terms”) govern your use of SCRATCHmail, an email and calendar app for Mac (the “App”), and the website at scratch.email (the “Site”), both provided by Scratchpad Studios (“SCRATCHPAD,” “we,” “us,” or “our”). By downloading, installing, or using the App, or by using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App or the Site.

1. Your License to Use the App

The App is licensed to you, not sold. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Mac computers that you own or control, for your own personal or internal business use.

You agree not to:

  • Copy, distribute, sell, rent, lease, sublicense, or otherwise make the App available to others, except as the law expressly allows.
  • Modify the App, create derivative works from it, or reverse engineer, decompile, or disassemble it, except to the extent that applicable law permits this despite this restriction.
  • Remove or alter any copyright, trademark, or other proprietary notice in the App.
  • Use the App to break the law, to send spam or other unsolicited bulk messages, to distribute malware, or to infringe or violate the rights of others.
  • Use the App to gain access to any account, mailbox, or system that you are not authorized to use.

2. Your Google Account

The App works with Google Workspace and Gmail accounts through Google’s APIs, using an OAuth client that you create in your own Google Cloud project. You are responsible for:

  • Your Google accounts and Google Cloud project, including any fees, quotas, or limits that Google applies to them.
  • Complying with Google’s terms and policies, including the Google Terms of Service and the terms that apply to Google’s APIs.
  • Having permission to connect each account you add, including any approval your Google Workspace administrator requires.
  • Keeping your Mac, your Google credentials, and your OAuth client secret secure.

SCRATCHmail is an independent product. It is not affiliated with, endorsed by, or sponsored by Google LLC or Apple Inc. Google may change, limit, or discontinue its APIs at any time, which may affect or end the App’s ability to work. We are not responsible for Google’s services or for changes that Google makes to them.

3. Your Content

Your email, calendar events, contacts, and attachments belong to you. The App stores them on your Mac and exchanges them directly with Google. We do not receive them and claim no rights in them. Our Privacy Policy describes this in detail.

You are solely responsible for the messages you send and the content you handle with the App, and for keeping any backups you need.

4. Features That Run on Your Mac

Several features depend on the App running on your Mac. Reminders, snoozed conversations, Send Later, and the Undo Send delay are handled locally, and they pause if you quit the App, shut down your Mac, or lose your network connection. A scheduled message will not be sent until the App is running and online. Drafts are stored only on your Mac and are not synced to Gmail. Please do not rely on the App as the only safeguard for time-critical or high-stakes messages.

5. Updates and Availability

We may release updates, change or remove features, or stop offering the App at any time. Some updates may be required for the App to keep working with Google’s services. The App is currently built for Apple silicon Macs, and we do not promise support for any other platform. We have no obligation to provide maintenance or technical support, though we welcome bug reports and feedback at info@scratchpadstudios.com.

6. Fees

If we charge for the App or for any feature of it, the price and payment terms will be shown to you before you buy, and those terms will apply in addition to these Terms. Unless we say otherwise at the time of purchase, or the law requires it, payments are non-refundable.

7. Feedback

If you send us ideas, suggestions, or bug reports, you agree that we may use them without restriction and without owing you compensation.

8. Use of the Site

The Site is provided to describe the App and make it available for download. You may use the Site only for lawful purposes. You agree not to attempt to gain unauthorized access to the Site or the systems that host it, not to interfere with its operation or impose an unreasonable load on it, not to introduce malicious code, and not to use automated means to access it other than customary search engine indexing.

9. Intellectual Property

The App and the Site, including all software, text, graphics, logos, and designs, are owned by SCRATCHPAD or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Except for the license in Section 1, these Terms give you no rights in them. The App includes open source software components, which are licensed to you under their own license terms.

SCRATCHmail, SCRATCHPAD, and the associated logos are trademarks of Scratchpad Studios. Mac and macOS are trademarks of Apple Inc. Gmail, Google Calendar, and Google Workspace are trademarks of Google LLC. All other trademarks are the property of their respective owners.

10. Third-Party Links and Services

The App and the Site rely on or link to services operated by others, including Google’s APIs and web fonts. Links you open from an email message lead to third-party websites. Those services and sites are governed by their own terms and privacy policies, and we accept no responsibility for them.

11. Termination

You may stop using the App at any time by deleting it and its data from your Mac. Your license ends automatically if you fail to comply with these Terms, and we may end it at any time by notice. When your license ends, you must stop using the App and delete all copies of it. Sections 3, 7, 9, and 12 through 16 continue to apply after termination.

12. Disclaimer of Warranties

THE APP AND THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SCRATCHPAD DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, THAT ANY MESSAGE, REMINDER, OR SCHEDULED SEND WILL BE DELIVERED OR WILL OCCUR ON TIME, OR THAT YOUR DATA WILL NOT BE LOST.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SCRATCHPAD, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP OR THE SITE, INCLUDING ANY MESSAGE THAT IS LOST, DELAYED, MISDIRECTED, OR NOT SENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless SCRATCHPAD and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the App or the Site, or the messages and content you send or handle with the App.

15. Governing Law and Disputes

These Terms and any dispute or claim arising out of or related to them, the App, or the Site are governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.

You may not use or export the App in violation of United States export laws and regulations.

16. Changes and General Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a new effective date. Your continued use of the App or the Site after changes are posted means you accept the revised Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not constitute a waiver of it. You may not assign these Terms without our consent. These Terms, together with our Privacy Policy and any terms presented at purchase, constitute the entire agreement between you and SCRATCHPAD regarding the App and the Site.
